Welcome to MagicPlus CRM! This document will outline, in detail, the rights of you, the client, as well as the rights of the creators of MagicPlus CRM. MagicPlus CRM cannot guarantee everything will be completely without issue, of which you, the client, acknowledge at this time.

Terms of Service:

The Terms of Service constitutes a contract between you, the client, and MagicPlus CRM, LLC. The Terms include the provisions set forth in this document and other terms or conditions that may be presented to you in connection with specific Service offerings which MagicPlus CRM collectively refer to as the “Terms of Service” or “Terms”. The Service is owned and operated by MagicPlus CRM, LLC. The Service MagicPlus CRM offers is “without” modification and is subject to you, the client(s), acceptance. If you do not agree to these Terms, you, have no legal right to access or use our Service or services from the MagicPlus CRM, LLC. If you, the client, do register for or otherwise use our Service, you, shall be deemed to confirm your acceptance of the Terms of Service and other conditions and your agreement to be a party to this binding contract.

Upon accessing or using MagicPlus CRM website, you, the client, agree to be bound by all terms and conditions of this agreement and acceptance is expressly limited to these terms. The failure of MagicPlus CRM, LLC to enforce any right granted in the Terms of Service shall not constitute a waiver of such rights, and the Terms of Service at all times constitutes the complete agreement between you, and MagicPlus CRM, LLC which supersedes all prior agreements.

General Terms

If you do not agree to these Terms of Service, you must stop using the Service immediately. The client may only use the Service upon agreeing to these Terms. You must be at least 18 years old to use the Service and your use of the Service is considered undertaken at your own risk. The Service is presented “as is” and “as available”. The client may not use the Service for any unauthorized or illegal purposes and the client may not use the Service in violation of any laws in your jurisdiction. The client is responsible for all activity that occurs under their account, including posted Content. The client also assumes responsibility for all activity and Content posted by others who have accounts under your account. MagicPlus CRM, LLC does not expressly guarantee or warrant that the use of this Service will meet the client requirements, nor that the use of the Service will be uninterrupted or free from error. MagicPlus CRM, LLC does not expressly guarantee that any and all defects in the operation of the Service will be corrected. Technical support is and will be, provided via email and phone, and is available to both trial users and paying users. However, MagicPlus CRM, LLC reserves the right to refuse support for any reason. The client acknowledges and understands that MagicPlus CRM, LLC uses a third party vendor and hosting partner to provide necessary infrastructure, e.g. networking, storage, hardware, software, etc. to run the Service. The client agrees not to use the Service to transmit any malicious code, such as computer viruses or worms that can damage any MagicPlus CRM, LLC or vendor infrastructure. Any abuse of any MagicPlus CRM, LLC user or employee, whether written, physical, or verbal will result in immediate termination of the client account. If the client usage far exceeds the average usage of other MagicPlus CRM, LLC users, MagicPlus CRM, LLC reserves the right to deactivate the client account until a time at which the client usage can be restored to more normal levels. MagicPlus CRM, LLC cannot be held responsible for any damages, loss, or harm, either directly, indirectly, incidental, or otherwise, resulting from a lack of access to the Service, the result of any Content stored in the Service or the procurement thereof, unauthorized access to your account, data, or transmissions, or any other matter relating to the Service. MagicPlus CRM, LLC makes no claim that using the Service provided by MagicPlus CRM, LLC that you, the client, will profit, gain additional business or in otherwise succeed because of the use of MagicPlus CRM, LLC.

Changes In Terms of Service

Changes in the Terms are almost, always inevitable due to changes in our Service and the laws that apply to the client and MagicPlus CRM, LLC and MagicPlus CRM, LLC will always attempt to explain the reason for the change. If we make a change, MagicPlus CRM, LLC, will do our best to provide you with advance notice. However, certain situations may warrant an immediate change, to update these Terms to satisfy applicable legal requirements. Magic Plus CRM, LLC will announce any changes on MagicPlus CRM, LLC home page, but we may also elect to email any notification of change to the address you have provided to MagicPlus CRM, LLC. If MagicPlus CRM, LLC does update these Terms, you, the client, are free to decide whether to accept the terms or to stop using the Service provided by us. Your continued use of the Service after the update or change to Terms is put in to effect will be deemed as your agreement with, and consent to be bound by, the new Terms. No other amendment or modification of these Terms, except for changes made by us MagicPlus CRM, LLC as described here, shall be effective unless set forth in a written agreement bearing a written signature by you, the client, and MagicPlus CRM. Email or other form of communications does not constitute an effective written agreement for this purpose.

To Begin Service with MagicPlus CRM, LLC

The client must provide an acceptable and valid business name, email address, and any other information requested as a part of the signup process. The security of your password and account name are solely your, the client(s), responsibility. MagicPlus CRM, LLC encourages the client to use a non-obvious password for their account. MagicPlus CRM, LLC cannot be held responsible or liable for any loss resulting from the failure to comply with this security obligation.

Payment and Refunding Terms

A valid credit card is required to maintain an active account after the end of the free trial period. All accounts are granted a free 30-day trial upon registration. After the trial has ended, a notification will be sent on to you and a grace period of approximately five days will begin. At the end of the grace period, if, payment information has not been received, the account is subject to be archived or deleted by MagicPlus CRM, LLC. If payment information is received prior to the end of the trial period, the first month’s payment will be billed immediately. Any remaining trial days will be added to the subsequent monthly payment cycle.

Month to Month Billing

If the service is billed monthly it will be billed each month on the same day of the month and is non-refundable. MagicPlus CRM, LLC will consider requests for refunds of the latest month’s payment at the discretion of owners of MagicPlus CRM, LLC.

Yearly Billing

If the service is billed yearly it will be billed on the same day of the year as when you sign up. A partial refund will be given if service is stopped within 30 days of signup. After 30 days the service will be non-refundable. The client shall be responsible for any taxes, levies, or duties imposed by the relevant taxing authorities of their jurisdiction. All fees, taxes, levies, and duties issued by the Service are exclusive.

Terms of Cancellation

If you wish to cancel your account with MagicPlus CRM, LLC, you are responsible for properly ensuring cancellation. While the Service may assist you in cancellation in the event of your account via email or phone. If you cancel your account in advance of your billing date for the upcoming month or year, your credit card will not be charged again. Upon cancellation of your account, all data and information from the account is subject to indefinite archiving or deletion. Should any of your data remain on the MagicPlus CRM, LLC or third party vendor servers after cancellation, without client consent data will not be viewed or disseminated in any way. MagicPlus CRM, LLC reserves the right to suspend or terminate the client account at any time and for any reason if MagicPlus CRM, LLC deems such action necessary. This type of cancellation taken by MagicPlus CRM, LLC will subject client data from the account to either archival or deletion. MagicPlus CRM, LLC reserves the right to refuse service to anyone, at any time, and for any reason. MagicPlus CRM, LLC also reserves the right to limit access on use at anytime for any reason deemed necessary.

Terms Of Modification

MagicPlus CRM, LLC reserves the right to suspend or discontinue the Service (or any part of the Service) at any time, and for any length of time, with or without notice. Prices for the service are subject to change with 30 days notice from MagicPlus CRM, LLC. Notice for price change will be provided via MagicPlus CRM, LLC, and/or email notification to the address provided upon registration. MagicPlus CRM, LLC is not liable to you or any third party for any changes made to the service, alterations to the pricing of the Service, or discontinuation of the Service. Client acknowledges that the Service is subject to change in form at any time without their prior consent as MagicPlus CRM, LLC works to improve and innovate upon the existing Service. MagicPlus CRM, LLC retains the right, in our sole discretion, to implement new elements as part of and/or ancillary to the Service and any Software, including changes that may affect the previous mode of operation of the Service. We expect that any such modifications will enhance the overall Service, but it is possible that you may not agree with us. The client acknowledges that a variety of MagicPlus CRM, LLC actions may impair or prevent them from accessing client content or using the Service at certain times and/or in the same way, for limited periods or permanently, and agree that MagicPlus CRM, LLC has no responsibility or liability as a result of any such actions or results, including, without limitation, for the deletion of, or failure to make available to you, any content. Client agrees that MagicPlus CRM, LLC shall not be liable to them or to any third party for any modification, suspension or discontinuance of any part of the Service. Any and all content added to the Service provided by MagicPlus CRM, LLC shall comply with all US copyright laws. Client retains ownership of all intellectual property over any Content added to your account in MagicPlus CRM, LLC, in accordance with privacy policy of MagicPlus CRM, LLC. MagicPlus CRM, LLC reserves the right to remove Content that is available via the Service at its discretion. MagicPlus CRM, LLC is not obligated to remove Content from the Service at any time. Client agrees to not sell, distribute, reverse engineer, copy, duplicate, or otherwise attempt to extract the source code of the Service or any part thereof. Client Data

Any and all data that is retrieved by you from your clients is your sole responsibility. Further, you certify that any data captured on your clients was done so legally and in accordance with federal, state and local laws. By agreeing to these “Terms”, you certify that MagicPlus CRM, LLC is not responsible for any data you enter into the CRM. This includes, but is not limited to, contact information, dates of birth, social security numbers, credit card data, and any other data that is specific to your client. In the event of a breech, you absolve MagicPlus CRM, LLC from any wrongdoing.

Right to Engage Third Parties

MagicPlus CRM, LLC reserves the right to engage certain third parties to perform certain functions associated with the operation of the MagicPlus CRM, LLC, and/or provide technical or other services relating to all or part of the Service, and you hereby agree that such third party involvement is acceptable.

Right to Use Third-Party Software

MagicPlus CRM, LLC may from time to time include as part of the Service and MagicPlus CRM Software computer software supplied by third parties which is utilized by permission of the respective licensors and/or copyright holders on the terms provided by such parties. MagicPlus CRM, LLC expressly disclaims any warranty or other assurance to you regarding such third party software.
